Information on personal data processing pursuant to Article 13 of EU Regulation 2016/679 (GDPR)

In observance of the provisions contained in EU Regulation 2016/679 (General Data Protection Regulation) at art. 13, we provide You the due information related to the processing of your personal data.

1. 2. DATA PROTECTION OFFICER (DPO/RPD). Designation not compulsory.

3. PURPOSE AND LEGAL BASIS OF THE PROCESSING

Any personal data you provide will be processed for the following purposes:
- the personnel selection; the implementation of the research activity and the personnel selection in order to establish a working relationship, also for different jobs from those for which the person concerned has spontaneously sent this job application; the retention of personal data for future selections; the applications management in response to job vacancies posted on our website; interviews and video-talks (data processing of images/audio).

If references are needed by contacting (if necessary) third parties (such as Universities, ex-employers, schools, etc.), you will be asked to consent during the interview.

LEGAL BASIS: the processing will be carried out pursuant to Article 6 EU Regulation 2016/679: - on the basis of the implementation of pre-contractual measures adopted at request of the data subject; or - on the basis of the treatment necessary to pursue the legitimate interest of the Data Controller or third party, taking into consideration the reasonable expectations of data subjects at the moment of the processing, when he can reasonably expect at the time and in the context of the collection of the personal data that processing for that purpose may take place; - in case of references, the legal basis of the processing is the consent of the data subject.

4. RECIPIENTS OR CATEGORIES OF RECIPIENTS OF THE DATA

Personal data provided will be communicated to recipients, who will process the data in their capacity as processors (Article 28 of EU Reg. 2016/679) and/or as an individual acting under the authority of the Controller and Processor (Article 29 of EU Regulation 2016/679), for the purposes listed above under point 3. More specifically, personal data will be communicated to:
- Group companies; - Companies providing services for the management of the information system and communication networks (including e-mail); - firms or companies as part of advisory and consultancy relations; - possible third parties (labour consultants and/or companies) for the purpose of personnel selection; - possible third parties for the purpose of obtaining references (Universities, ex-employers, schools, etc.); - competent authorities for compliance with legal obligations and/or provisions of public bodies, on request.

Entities belonging to the above categories act as Processors, or operate completely independently as separate Controllers. The list of Processors is constantly updated and is available writing at privacy@melcohit.com or at the registered office: via Caduti di Cefalonia n.1 - 36061 Bassano del Grappa (VI) – Italy.

5. TRANSFER OF DATA TO A THIRD COUNTRY AND/OR INTERNATIONAL ORGANISATION AND SAFEGUARDS

The personal data provided may be transferred to countries belonging to the European Union in order to fulfil the purposes connected with their transfer. More specifically, the personal data will be transferred according to Article 44 - General principle for transfers; Article 45 - Transfers on the basis of an adequacy decisions; Article 46 - Transfers subject to appropriate safeguards (including with contractual clauses and other provisions referred to in Article 46, para. 3).

The data subject may obtain information on the safeguards for the transfer of data by sending an e-mail to privacy@melcohit.com.

6. PERIOD FOR WHICH DATA WILL BE STORED OR THE CRITERIA USED TO DETERMINE THAT PERIOD

The data processing will be carried out in automated form, with modalities and tools aimed at guaranteeing the safety and the confidentiality, by those who have been designated to carry out the processing.

In accordance with art. 5 comma 1 let. e) of EU Regulation 2016/679 the personal data collected will be kept in a form which permits identification of data subjects for no longer than is necessary for the purposes for which the personal data are processed.
The timing, which however does not exceed 24 months, is determined on the basis of criteria established by the Controller: you may have information about these by writing to privacy@melcohit.com

7. RIGHTS OF THE DATA SUBJECT

You may exercise your rights as expressed in EU Regulation 2016/679 by contacting the Controller, either by e-mail to privacy@melcohit.com or by writing to the Controller’s address indicated above.
You have the right, at any moment, to ask the Controller for access to your personal data (Art. 15), rectification (Art. 16) or erasure (Art. 17) of your personal data, or restriction of processing (Art. 18) or object to the processing of your data (Art. 19) and data portability (Art. 20). You also have the right to lodge a complaint with a supervisory authority.

8. PROVISION OF PERSONAL DATA

The communication of personal data is NOT a legal obligation. Failure to provide personal data will make the job application impossible. The data providing for obtaining references is optional and does not affect the application.
