Information on personal data processing pursuant to Article 13 of EU Regulation 2016/679 (GDPR) - personal data collected from the data subject

In observance of the provisions contained in EU Regulation 2016/679 (General Data Protection Regulation)we hereby provide you with the necessary information on the processing of personal data. The information must not be considered valid for other websites that may be consulted through links on the domain controller’s internet sites, which are not to be considered in any way responsible for third party websites.

This information is given pursuant to Article 13 of EU Regulation 2016/679(General Data Protection Regulation) and is also inspired by the provisions of Directive 2002/58 / EC, as updated by Directive 2009/136/CE, on Cookies as well as by the provisions of the Authority for the Protection of personal data of 08.05.2014 in concerning cookies.

3. PURPOSE AND LEGAL BASIS OF THE PROCESSING

Any personal data you provide will be processed with due regard to the conditions of lawfulness pursuant to Article 6 f) EU Regulation 2016/679 for the following purposes:
- navigation on this website;
- Possible filling of data collection form, login and / or contact request with sending of the requested information that will be provided by the sales / distribution network on the territory;
- possible filling of data collection form for personnel selection;
- possible filling of data collection form for receiving newsletters or promotional communications in general via e-mail.

LEGAL BASIS:of the processing is the contract ex art. 6 par. 1 lett. f) of EU Regulation 2016/679 Legitimate Interest - data processing is based on Article 6 par. 1 f) (recital 47) the legitimate interests pursued by the controller or by third parties as a legal basis for processing, taking into account the reasonable expectations of the data subject at the moment and as part of the collection of personal data, when the data subject can reasonably be expected to be processed for this purpose.

4. RECIPIENTS OR CATEGORIES OF RECIPIENTS OF THE DATA

Personal data provided will be communicated to recipients, who will process the data in their capacity as processors (Article 28 of EU Reg. 2016/679) and/or as an individual acting under the authority of the Controller and Processor (Article 29 of EU Regulation 2016/679), for the purposes listed above under point 3. More specifically, personal data will be communicated to:
-Group companies; - any commercial partners (if suppliers of informatic systems), - to the sales / distribution network on the territory; Subjects providing services for the management of the information system and communication networks (including e-mail); -legal and technical consultants; - Persons providing services for the management of the information system and communication networks (including e-mail); - firms or companies as part of advisory and consultancy relations; - competent authorities for compliance with legal obligations and/or provisions of public bodies, on request. In case of administrative and accounting purposes, data may be transmitted to commercial information companies for assessing creditworthiness and payment practices and/or to persons for credit recovery purposes.
Entities belonging to the above categories act as Processors, or operate completely independently as separate Controllers. The list of Processors is constantly updated and is available at the registered office: via Caduti di Cefalonia n.1 - 36061 Bassano del Grappa (VI) – Italy.

5. TRANSFER OF DATA TO A THIRD COUNTRY AND/OR INTERNATIONAL ORGANISATION AND SAFEGUARDS

The personal data provided may be transferred to countries belonging to the European Union in order to fulfil the purposes connected with their transfer.

More specifically, the personal data will be transferred according to Article 44 - General principle for transfers; Article 45 - Transfers on the basis of an adequacy decisions; Article 46 - Transfers subject to appropriate safeguards (including with contractual clauses and other provisions referred to in Article 46, para. 3). The data subject may obtain information on the safeguards for the transfer of data by sending an e-mail to privacy@melcohit.com

6. PERIOD FOR WHICH DATA WILL BE STORED OR THE CRITERIA USED TO DETERMINE THAT PERIOD

Processing can be automated and manual, performed using methods and instruments aimed at ensuring maximum security and confidentiality, by persons or entities duly appointed to carry out processing.

In compliance with Article 5 comma 1 lett. e) of EU Regulation 2016/679, the personal data collected will be kept in a form which permits identification of data subjects for no longer than is necessary for the purposes for which the personal data are processed. Storage of the personal data provided depends on the purposes of the processing:
- navigation on this website (session);
- for contact request (maximum 1 year);
- data collection for personnel selection (maximum 24 months);
- receiving newsletters or promotional communications in general via e-mail (maximum 24 months);

7. RIGHTS OF THE DATA SUBJECT

You may exercise your rights as expressed in EU Regulation 2016/679 by contacting the Controller, either by email to privacy@melcohit.com or by writing to the Controller’s address indicated above.

You have the right, at any moment, to ask the Controller for access to your personal data (Art. 15), rectification (Art. 16) or erasure (Art. 17) of your personal data, or restriction of processing (Art. 18) or object to the processing of your data (Art. 19) and data portability (Art. 20).

If the data processing is based on consent, data subject has the right to withdraw the consent at any time without prejudice to the lawfulness of the processing based on the consent given prior to the withdrawal.

You also have the right to lodge a complaint with a supervisory authority.

There is no automated decision-making.

8. PROVISION OF PERSONAL DATA

The communication of personal data is not a legal or contractual obligation or a necessary requirement for the conclusion of a contract.
